Harley Davidson Will Face Class Action Over Hot Engines
A defective products class action lawsuit against Harley Davidson, filed by four bikers who allege their Harley Davidson motorcycles were defectively designed, can go forward.
The class action lawsuit claims that the Harley Davidson engines run so hot that they pose a constant danger to riders in that the engines cause burns and are therefore not fit for their intended use.
The complaint alleges that since 1999, Twin Cam 88, 96, 103 and 110 cubic inch engines in Harley motorcycles produce severe, excessive heat causing clothing to catch on fire, burn injuries and the danger of burn injury to riders and passengers as well as overheating causing premature engine wear and in models manufactured after 2006, transmission failure.
Although Harley Davidson asked the Eastern District of California court to throw out the claims under state law, a U.S. District Judge sided with the bikers. The recent ruling allows the case to move forward, and Harley Davidson will now face Class Action Certification process at the end of the month.

That judge needs to be removed from his seat. He probably doesn't understand that these idiots are probably using their bikes for burn outs and pulling wheelies in front of an audience. I've seen these guys doing their burnouts and yeah the bikes get hot as hell and I've heard them saying, yeah man, my bike's running too hot. Well what do you expect after doing a 2 minute burnout with almost no air flow over the engine? And how is it that they could claim it as, "Intended use"? anyway...The judge is a total dip shit.

Dumb asses. Three things people don't seem to understand here...
1. It's air cooled....they will run hotter when your putt putt around the neighborhood.
2. There are looser tolerances on air cooled engines...which counteracts the break down of oil on these hotter running engines to match those conditions of a liquid cooled engine. Same fukin design for decades...
3. The EPA has a HUGE hand in this....to pass EPA emissions, they have to lean the motors out a bit to pass factory emissions standards..

With the advent of CNC the tolerances have tightened on Harley air cooled motors to the point that since 1984 they are called bullet proof and each new purchase comes with long term factory guaranteed warrantees.MadCow wrote:

Though I do agree mine gets pretty hot on the hiway in 100 degree temps. I have Kuryakyn heat shields because of burning to my right inner thigh. Obviously Harley thinks they get hot also, hence the water cooled heads on the newer touring bikes. But, everybody I know realizes their bikes get hot and these guys surely knew it when they bought theirs. I doubt they win this case if it even makes it to trial......

Had six Harleys and never was on fire but once and that was my doing.Had chopped a 66FLH and to do away with the ten miles of dresser wiring had rewired it.When you are young and dumb you try anything.Going down the road feelin bad,a few thumbs up thrown at me [emoji106] .A smell like burnt plastic?Maybe the covering on a hot wire A line of smoke at top triple tree.Pull over and pull wires apart and fix the burnt ones good enough to make it home.Second wire job was still on it ten years later so guess I got better .
